Terms & Conditions | The Membership™
Effective Date: January 27th 2024.
1. Acceptance of Terms
By accessing or using the services provided by Regain Media Inc. ("we," "us," or "GetListings.com"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
2. Membership Subscription
2.1. GetListings.com offers a membership subscription for $97 USD per month or $997 USD per year.
2.2. Payment for the subscription is due in advance and will be automatically charged to the payment method provided by the member.
2.3. The subscription fee is non-refundable except as outlined in the refund policy.
3. Refund Policy
3.1. GetListings.com offers a 15-day refund policy.
3.2. To be eligible for a refund, the member must request a refund within 15 days from the date of initial subscription.
3.3. Refund requests can be submitted through the member's account in the Skool portal of GetListings.com or by contacting our customer support team at [email protected]
3.4. Refunds will be processed within 7 business days of receiving a valid refund request.
4. Cancellation
4.1. Members can cancel their subscription at any time through their Skool portal of GetListings.com or by sending an email to our customer support team at [email protected].
4.2. Cancellations made before the end of the billing period will not be refunded, and access to the services will continue until the end of the current billing cycle.
5. Changes to Subscription Plans
5.1. GetListings.com reserves the right to change the subscription plans, including pricing and features, with a 30-day notice to the members.
5.2. Members will be notified of any changes to their subscription plans via email and through the GetListings.com Skool portal.
6. Chargebacks and Disputes
6.1. Members affirm that GetListings.com has the right to authorize charges to the provided credit card, debit card, or bank details, regardless of the account’s ownership. Members assume full responsibility for all charges and agree to indemnify GetListings.com against any chargebacks, disputes, or payment reversals, ensuring payment for services rendered as agreed in this contract.
6.2. Members agree to contact GetListings.com directly to resolve any issues or dissatisfaction with services rendered before initiating a dispute with any credit card issuer or bank. Members acknowledge that initiating a chargeback is not an acceptable method of dispute resolution according to the terms of this agreement.
6.3.Members hereby waive their right to dispute charges with their bank or credit card issuer for services agreed upon in these terms and rendered by GetListings.com, except in cases of fraudulent use of their payment instrument by an unaffiliated third party. In the event of a chargeback being raised by Members against GetListings.com without prior direct dispute resolution attempts, Members agree to reimburse GetListings.com for any costs incurred in contesting such chargebacks, including, but not limited to, administrative fees, legal costs, and any associated fines from payment processors.
6.4. In the event of a chargeback or dispute initiated by a member, GetListings.com reserves the right to immediately suspend the member's access to the services.
6.5. Members are encouraged to contact GetListings.com support at [email protected] to resolve any concerns or disputes before initiating a chargeback.
6.6. Members agree that chargebacks or disputes initiated without prior communication and resolution attempts may result in termination of the membership without eligibility for a refund.
6.7. Members acknowledge that engaging in chargeback abuse may lead to legal action against them to recover any unpaid amounts and associated costs.
7. Non-Payment and Collections
7.1. In the event of non-payment by Members, GetListings.com reserves the right to initiate collection actions, including but not limited to hiring a debt collection agency or taking legal action. Members will be responsible for all costs associated with such collection efforts, including, but not limited to, collection agency fees, reasonable attorney’s fees, and court costs. 7.2. Failure to make payment within 45 days of the due date will result in the outstanding amount being referred to a debt collection agency.
7.3. In the event of a late payment, defined as any payment not received within 7 days of its due date, GetListings.com reserves the right to temporarily suspend services and remove Members from any ongoing programs until the outstanding payment is fully resolved. This suspension does not relieve Members of their financial obligations under the terms of this contract.
7.4. Furthermore, should services be suspended due to late payment, the reinstatement of services upon receipt of the overdue payment does not constitute an extension of the original contract term. The contract’s start and end dates remain unaffected by any period of suspension due to non-payment. Members are responsible for all payments agreed upon in the contract, regardless of any service suspension period.
7.5. Members acknowledge that GetListings.com will undertake collection actions for any outstanding payments, as outlined in the ‘Non-Payment and Collections Clause’, and will be responsible for covering all associated costs, including collection agency fees, legal fees, and court costs.
8. Intellectual Property
8.1. All content and materials provided as part of the GetListings.com membership are the property of Regain Media Inc. and are protected by intellectual property laws.
8.2. Members may not reproduce, distribute, or use any content from GetListings.com for commercial purposes without prior written consent from Regain Media Inc.
9. Termination
9.1. GetListings.com reserves the right to terminate a member's subscription at any time for violation of these Terms and Conditions or for any other reason.
9.2. In the event of termination, the member will lose access to the GetListings.com services immediately.
10. Governing Law
You agree that the laws of the Province of Quebec, Canada, without regard to conflicts of laws provisions, will govern these Terms and Condition and any dispute that may arise between you and Regain Media or its affiliates. You also agree that the courts of Montreal, Province of Quebec, Canada will have sole and exclusive jurisdiction to hear or determine any dispute or controversy arising under or concerning this Agreement.
11. Indemnification
You agree to indemnify, defend and hold Regain Media and our partners, employees, and affiliates, harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.
12. Disclaimer.
THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. GetListings.com DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.
13. Limitation of Liability.
UNDER NO CIRCUMSTANCES WILL REGAIN MEDIA BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES ANY POTENTIAL DAMAGES ARISING FROM CONTACT WITH OTHER PARTIES THROUGH THIS SITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.
You may have additional rights under certain laws (including consumer laws) which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in this Agreement that directly conflict with such laws may not apply to you.
14. Use of Information.
GetListings.com reserves the right, and you authorize us, to use and assign all information regarding site uses by you and all information provided by you in any manner consistent with our Privacy Policy.
15. Copyrights and Copyright Agent.
If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information via email to [email protected].
(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
(b) A description of the copyrighted work that you claim has been infringed;
(c) A description of where the material that you claim is infringing is located on the Site;
(d) Your address, telephone number, and e-mail address;
(e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
(f) A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
16. Severability.
If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
17. Waiver.
The failure of GetListings.com to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by GetListings.com must be in writing and signed by an authorized representative of GetListings.com.
18. Termination.
GetListings.com may terminate this Agreement at any time, with or without notice, for any reason.
19. Relationship of the Parties.
Nothing contained in this Agreement or your use of the Site shall be construed to constitute either party as a partner, joint venture, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.
20. Entire Agreement.
This Terms and Conditions constitutes the entire agreement between you and Regain Media and governs your use of the Site, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and GetListings.com with respect to this Site. Notwithstanding the foregoing, you may also be subject to additional terms and conditions, posted policies (including but not limited to the Privacy Policy), guidelines, or rules that may apply when you use the Website. GetListings.com may revise this Terms and Conditions at any time by updating this Agreement and posting it on the Site. Accordingly, you should visit the Site and review the Terms and Conditions periodically to determine if any changes have been made. Your continued use of the Website after any changes have been made to the Terms and Conditions signifies and confirms your acceptance of any such changes or amendments to the Terms and Conditions.
